Overview

Tax compliance is not optional, and tax optimization is not cheating. Understanding how the Brazilian tax system treats investment income allows investors to structure their activities in perfectly legal ways that meaningfully reduce their tax burden — sometimes by several percentage points of annual return.

This module covers everything the Brazilian investor and side-gig entrepreneur needs to know about their tax obligations: the annual IRPF declaration and its investimentos section, the monthly DARF obligation for stock and crypto capital gains, Carnê-Leão for self-employment income, the critical R$ 20.000/mês ação isenção and how to use it correctly, FII and crypto tax specifics, and the interaction between MEI income and personal IRPF.

This is not light reading. But it is essential. Every year, Brazilian investors pay thousands in unnecessary taxes because they do not understand the rules, or face autuações fiscais (tax assessments) because they did not comply. Both outcomes are avoidable.

IRPF Annual Declaration: Structure for Investors

The annual IRPF declaration (due April 30 each year) has multiple sections relevant to investors:

Bens e Direitos (Assets and Rights): Declare all investment balances at their acquisition cost (not current market value). This includes: - Bank accounts and CDBs (Grupo 04 — Aplicações e Investimentos) - Ações and ETFs (Grupo 03 — Participações Societárias) - FII quotas (Grupo 07 — Fundos) - Crypto (Grupo 08 — Criptoativos) - Tesouro Direto bonds (Grupo 04)

[!WARNING] The IRPF declaration always uses acquisition cost (custo de aquisição), not current market value. Declaring market value is a common error that creates a false capital gain.

Rendimentos Sujeitos à Tributação Exclusiva/Definitiva: Renda fixa income (CDB interest) is already taxed at source (IR retido na fonte). Declare the gross amount; the IR already paid appears in the declaration.

Rendimentos Isentos e Não Tributáveis: FII dividends (when meeting criteria), stock dividends, LCI/LCA income, and other exempt income go here.

Renda Variável: Monthly stock and FII trading results. Even if DARF was paid monthly, these must be consolidated in the annual declaration.

GCAP Monthly Calculation and DARF

For ações (individual stocks), GCAP applies when monthly total sales exceed R$ 20.000. The process:

  1. Track cost basis (custo médio) — When you buy the same stock multiple times at different prices, the cost basis is the weighted average: custo médio = total spent / total shares held

  2. Calculate gain per sale: gain = (sale price - custo médio) × shares sold

  3. Apply isenção rule: If total sales in the month are ≤ R$ 20.000, the gain is exempt. If > R$ 20.000, the entire gain is taxable (not just the portion above R$ 20.000).

  4. Apply loss carryforward: Losses from previous months can be offset against current month gains before calculating tax. Loss carryforward never expires.

  5. Calculate tax: 15% of taxable gain (20% for day trade)

  6. Generate DARF: Código de receita 6015 (ações). Due: last business day of the month following the sale.

Carnê-Leão: Self-Employment Income

Freelancers and consultants earning from pessoa física sources (not MEI clients) must use Carnê-Leão. MEI clients who pay via nota fiscal are NOT subject to Carnê-Leão — they pay via the MEI DAS system. Carnê-Leão applies to: - Payments received from individuals (not legal entities) - Foreign income (including AdSense, Upwork, international transfers) - Rental income from individuals

Monthly Carnê-Leão is calculated using the progressive IRPF table and paid via DARF (código 0190) by the last business day of the following month.

The R$ 20.000/mês Isenção: Correct Application

The most frequently misunderstood tax rule for Brazilian equity investors:

Correct rule: In any calendar month, if your total sales of individual ações (not ETFs, not FIIs, not day trade) are R$ 20.000 or less, ALL gains from those sales are exempt, regardless of the gain amount.

Critical clarifications: - The R$ 20.000 is measured by SALES VOLUME, not by gains - Selling R$ 20.001 of ações makes the ENTIRE gain taxable, not just the marginal R$ 1 - ETFs are EXCLUDED from this exemption (all ETF gains are taxable at 15%) - FIIs are EXCLUDED (FII capital gains taxed at 20%) - Day trade is EXCLUDED (taxed at 20% with no isenção)

Legal optimization strategies: - If you plan to sell more than R$ 20.000 of ações in a month, consider splitting the sales across two calendar months - A sale of R$ 19.999 in month 1 and R$ 19.999 in month 2 = zero tax - A single sale of R$ 39.998 = taxable at 15% on all gains


Key Concepts

IRPF (Imposto de Renda Pessoa Física) — Brazil's personal income tax. Annual declaration due April 30. Investors must declare all assets, income, and capital gains. The software (Programa IRPF) is free from Receita Federal's website.

DARF (Documento de Arrecadação de Receitas Federais) — Tax payment document used for monthly capital gains, Carnê-Leão, and other federal taxes. Generated via Sicalc (online) or e-CAC. Must be paid by the last business day of the month following the taxable event.

Custo médio ponderado — Weighted average cost per share. The basis for GCAP calculation. Must be recalculated with each purchase.

Prejuízo a compensar (loss carryforward) — Capital losses can offset future capital gains indefinitely. Track losses carefully — they have real tax value.

Código de receita — The tax code identifying the type of tax being paid via DARF. Key codes: 6015 (capital gains on ações), 0190 (Carnê-Leão), 0246 (capital gains on real estate), 4600 (capital gains on crypto).


Examples

GCAP calculation: multi-stock month

Transaction Details
Buy PETR4 200 shares × R$ 35 = R$ 7.000 (months earlier)
Buy PETR4 100 shares × R$ 40 = R$ 4.000 (weeks later)
Custo médio (7.000 + 4.000) / 300 = R$ 36,67/share
Sell PETR4 100 shares × R$ 45 = R$ 4.500 sale
Gain on PETR4 (45 - 36,67) × 100 = R$ 833

This month: total PETR4 sales = R$ 4.500. Under R$ 20.000. Exempt.

Next month: sell 200 shares of VALE3 for R$ 50.000 total. Cost basis VALE3: R$ 35.000. Gain: R$ 15.000. Sales > R$ 20.000: ENTIRE R$ 15.000 gain is taxable. Tax: R$ 15.000 × 15% = R$ 2.250. DARF due: last business day of following month.


Common Pitfalls

  • Not paying DARF monthly — Many investors learn about DARF only at IRPF declaration time in April, when they owe months of back taxes plus interest (Selic rate) and fines (0.33%/day for first month, then 20% + Selic after).
  • Not tracking cost basis — Without accurate cost basis records, GCAP calculation is impossible. Use a spreadsheet or dedicated app from day one.
  • Applying isenção to ETFs — ETFs are explicitly excluded from the R$ 20k isenção. This error is extremely common.
  • Not carrying forward losses — Untracked losses from bad months cannot be applied to offset good months' gains. Lost tax value that never expires.
  • Declaring investments at market value — Always declare at acquisition cost in Bens e Direitos.
